I have told him repeatedly over the years that I don't want custody or guardianship over my nephew.

And if he had a heart attack or a stroke and I was living with him (I want to move out and get a place of my own) that he would expect me to take over childcare duties.

I am worried if he took over custody, he would assign custody to me.

He is nearly 77 years old, is having issues with his hips and has diabetes and seems to me at least to be showing signs of the early stages of dementia.

Now I am worried that something would happen to sister, and my dad would take over.

I have decided that it is in my best interests and the best interests of any child or guardian that I not have kids or not adopt or have any sort of custody over children.

I have Aspergers and anxiety and depression issues, and I sometimes am not as patient with my nephew as I should be.

I am concerned because she has no will or guardianship provision in place for her child in case she dies, and my dad feels that my nephew is better off with him.

My sister has had plans on and off to move in with boyfriends and take her son with her, but she keeps changing her mind, and staying with my dad.
